Baylor University has filed a trademark infringement lawsuit against Boston University, asserting that Boston’s use of an interlocking “BU” logo is confusingly similar to Baylor’s federally registered trademark.
The lawsuit states that Baylor has used its interlocking BU design since at least 1912 and secured federal registration for the mark in 1987. According to the complaint, the two universities established a coexistence agreement decades ago that permitted both schools to use their respective logos under specific conditions.
Baylor alleges that Boston University has recently violated this agreement by expanding the use of its logo beyond the agreed-upon scope, particularly on merchandise and apparel for club sports. After a formal request in 2021 for Boston to stop using the design was allegedly ignored, Baylor is now seeking a court order to compel Boston University to cease all use of the logo.
The university is also asking the court to order the destruction of all infringing materials, arguing that Boston’s continued use causes consumer confusion and inflicts irreparable harm on the Baylor brand.
