The Senate declares the senatorial seat for Tamaulipas vacant after the death of Faustino López Vargas

The Senate of the Republic will declare the senatorial vacancy by Tamaulipasa position held by Senator Faustino López Vargas, who died last Saturday in a car accident, and will issue the call for extraordinary elections to cover it.

The Tamaulipas senator of the party National Regeneration Movement (Morena) assumed the position as substitute for Américo Villarreal Anaya, today the constitutional governor of Tamaulipas.

In the absence of the owner senator and his alternate, as is the case, the Constitution establishes a term of three months for the election of a new formula -made up of the owner and the alternate- who occupies the position of senator by the principle of majority relative.

The High camera has 30 days to issue the call for extraordinary elections, from the time Faustino López Vargas is declared vacant.

Article 77 of the Constitution, section IV, provides that “Each of the Chambers can, without the intervention of the other:

“IV. Issue a call, within a term of 30 days from the occurrence of the vacancy, for extraordinary elections that must be held within the following 90 days, in order to fill the vacancies of its members referred to in article 63 of this Constitution, in the case of vacancies of deputies and senators of the Congress of the Union by the principle of relative majority, unless the vacancy occurs within the final year of the exercise of the corresponding legislator.

While article 63 orders:

“Both the vacancies of deputies and senators of the Congress of the Union that arise at the beginning of the Legislature, as well as those that occur during its exercise, will be covered: the vacancy of deputies and senators of the Congress of the Union by the principle of relative majority , the respective Chamber will convene extraordinary elections in accordance with the provisions of section IV of article 77 of this Constitution.

López Vargas held the seat as substitute senator in two periods, after Villarreal Anaya requested a license to the position to contend for the governorship of Tamaulipas: from January 2 to September 26 of the current year, and then from September 28 to the last Saturday, October 8, when he lost his life along with his wife Pilar Hernández in a road accident aboard their car; They were going to Zacatecas to attend the legislative report of their co-religionist María Soledad Luévano Cantú, which was canceled when the tragedy was known.

It will be the second time that the High camera issue a call for extraordinary elections during the LXIV and LXV Legislatures, whose members were elected on July 1, 2018, due to the existence of vacancies.

The first time was on October 5, 2021; the Senate issued the call for extraordinary elections, which were held two months later, on December 5, after declaring the senatorship of Nayarit vacant by the principle of relative majority after the owner senator Miguel Ángel Navarro Quintero separated from office to contend for the governor of that state, which he won, and alternate senator Daniel Sepúlveda Árcega was unable to take office because his victory was revoked by the electoral jurisdictional authority.
