A total of 49 senators from the National Action parties (PAN), Institutional Revolutionary (AT), Citizen movement (MC), of the Democratic Revolution (PRD) and without party filed before the Supreme Court of Justice of the Nation (SCJN) a demand for an action of unconstitutionality against the secondary reforms, recently approved by the Congress of the Union, which establish the assignment of the National Guard to the Secretariat of National Defense (Sedena).
Enacted last September 9, the contested decree reforms and adds various provisions of the Organic Law of the Federal Public Administration, the National Guard Law, the Organic Law of the Mexican Army and Air Force and the Law of Promotions and Rewards of the Army and Mexican Air Force, in matters of National Guard and public security.

According to the document signed by the 49 promoting senators, the coordinators of the parliamentary groups of the PAN, AT, MC, PRD and without a party, Julen Rementería, Miguel Ángel Osorio Chong, Clemente Castañeda, Miguel Ángel Mancera and Emilio Álvarez Icaza, respectively, were appointed “common representatives” before the highest constitutional court to hear the appeal filed.
The Constitution establishes in its Article 105 that the SCJN it will know and resolve the actions of unconstitutionality that have the purpose of raising the possible contradiction between a rule of a general nature and the Magna Carta.
As well as that said actions must be exercised “within thirty calendar days following the date of publication of the norm”, by “the equivalent of 33% of the members of the Senate, against federal laws or international treaties concluded by the Mexican State”.
The aforementioned lawsuit was filed yesterday, October 10, the deadline established to do so.
“The resolutions of the Supreme Court of Justice of the Nation may only declare the invalidity of the contested norms, provided that they were approved by a majority of at least eight votes,” orders the Constitution.
