A federal court declared unfounded a complaint filed by Genaro García Luna, former Secretary of Public Security during the government of President Felipe Calderón, to have access to one of the investigation files that the FGR opened against him.
It was announced that the former federal official was seeking access to one of the investigations that the Attorney General’s Office (FGR) has against him for crimes related to organized crime and illicit enrichment for more than 27 million pesos, in order to demonstrate that the property insured by the agency was legally purchased.
These properties are a property in the Paseos del Sur neighborhood in Xochimilco; in the Jardines en la Montaña neighborhood, in Tlalpan; and in the Pedregal de las Fuentes subdivision, in the municipality of Jiutepec, Morelos.
However, when analyzing the appeal filed by the former secretary – who is detained in the US accused of having links with the Sinaloa Cartel – the federal court of our country accused the arguments presented by the defense of the former official as unfounded and, unanimously , denied giving access to the investigation folder, which gave the reason to the judge of the Sixteenth District of Amparo in Criminal Matters who last July issued the same sentence against García Luna.
Legal representatives
It should be noted that, in August 2021, alleged legal representatives of García Luna appeared before the FGR to be recognized as his defenders, a request that was rejected, since the prosecutor in charge of the investigation stated that the protection he received presented certain discrepancies in Garcia Luna’s signatures.
“This authority, for the time being, is not certain that Genaro García Luna has actually been able to be visited in the place where he is being held by someone to obtain his signature on writings in his name, in accordance with the restrictions that there are derivatives of the Covid pandemic in the detention center where he is located, ”the FGR said at the time.
This after he presented a copy of an official letter, issued by the Office of International Affairs of the United States Department of Justice, which mentions that access to people held in federal penitentiary centers in United States territory was restricted by the measures implemented by the pandemic.
