STPS calls on the maquiladora industry to conclude CCT legitimation processes within 6 months

In a new meeting with businessmen from the National Council of the Maquiladora and Export Manufacturing Industry (INDEX), the Secretary of Labor and Social Welfare, Luisa Maria Mayor Lujanasked to face the challenge of celebrating the processes of legitimation of collective labor contracts in the period of six months that remain for the term to end.

During the master conference “Labor Reform in Mexico, perspectives for IMMEX”, held within the framework of the 47th INDEX National Convention, the person in charge of labor policy referred to the challenge of concluding the legitimacy of collective contracts that are alive in Mexico. the country, to date, he said, “there are 7,167 legitimized contracts, with 2 million workers consulted, but there are many in this industry and others who have not gone through this process.”

He pointed out the existence of a maximum time limit, next May 1 for the expiration of the four years that were established to legitimize collective contracts.

“There are practically six months to conclude and although it is a process that corresponds to the unions, the companies must also be involved,” he said.

The collective contracts that are not legitimized, explained Luisa María Alcalde, are considered terminated and the company must respect all the clauses, as well as the rights and benefits that were in the collective contract, but now, individually, in addition to the possibility to include one or more unions, a situation in which an attitude of neutrality must be adopted.

He added that the challenge is not only the process of legitimation, later a second challenge will come, with the comprehensive reviews carried out through consultations with the workers and for them to be successful, union leaders are needed who generate trust in the people, closeness with the workers and constant communication with them, to avoid rejection of what was agreed upon.

He pointed out to the companies that the best way to avoid a complaint before the TMEC is to assume the new democratic rules in the world of work and leave behind the old practices, which have been the ones that originated the 5 complaints of the Rapid Response Mechanism, resolved adequately, without reaching international panels.
