The lack of legal certainty about the assets is one of the concerns that afflicts millions of Mexican families, who are forced to live in their homes without having documents that legally prove that the property Belongs to them.
According to the president of the National Association of Mexican Notaries, Guillermo Escamilla Narváez, in Mexico there are around 10 million homes in this situation, for which he insisted that actions must be taken that impact the entire country.
“A notarial conference at the national level should be promoted in which those properties that, at this time, do not have the elements to be in a formal market can be regularized,” he commented during the Second Notarial Housing Seminar.
In this context, the Association signed an agreement with the Secretariat of Agrarian, Territorial and Urban Development (Sedatu) that determines various lines of action to promote the legal certainty in the properties.
During his participation, Román Meyer Falcón, head of Sedatu, reported that, through the National Institute of Sustainable Land (Insus), more than 100,000 deeds have been delivered so far this six-year term.
He also stressed that special effort should be put into illegal sale of propertyespecially in the south of the country.
“There is a significant number of national lands, particularly on the peninsulas, since real estate development there is particularly fast. You have to be very careful,” the official said.
Approval of public records
With the signing of the agreement, the National College of Mexican Notaries also seeks to promote proposals to improve practices and modernize the Public records of the propertyin order to be a means by which the rights of Mexicans are guaranteed.
“There is the minutes of the Law to homologate the Public records of the property and cadastres at the national level, we hope that it can soon be approved in the Senate. We must think not of the 35 million homes in the country, but of the 35 million families that inhabit them,” insisted Narváez.
Meyer Falcón explained that one of Sedatu’s strategies has been the updating of more than 50 registration and cadastre programs, which has increased the collection of local governments by more than one billion pesos.
“If we take this to a larger scale, these resources could be used for infrastructure, water services, electricity, etc. That is why updating the instruments and promoting coordination with actors in the sector is essential to reduce the lag in legal certainty”, concluded the head of Sedatu.
