The Chamber of Senators supports the changes to the bill that reforms the General Law of Social Communication (LGCS) and General Law of Administrative Responsibilities (LGRA), although for reasons of “legislative technique” it will modify 59 articles of both regulations.
If the suggested amendments are approved today in committees, and tomorrow by the full chamber, the corresponding decree will be returned to the Chamber of Deputies for a new review.
“These United Commissions for the Interior and for Second Legislative Studies consider the legal modifications contained in the draft under study viable and timely, the purpose of which is to safeguard the right of expression of public servants, the human right of citizens to information about the public action and accountability, through government propaganda, constituted by that which the Public Entities hire in the mass media”, cites the draft opinion.
“Imprecise wording”
The modifications to be made in the wording of the articles, it is clarified, are due to “the fact that their current wording is imprecise and sometimes ambiguous as it does not clearly and precisely reflect what is actually being reformed, added or repealed”.
The senators will modify article 26 of the LGCS to “make it coincide with the principles, criteria and rules established in the normative body”.
Said article will specify that in the federal entities the spending limit made in Social Communication must not exceed 0.1% of the corresponding annual Expenditure Budget; the same percentage is authorized at the federal level.
From the perspective of the members of the ruling commissions, it is “wise and pertinent” that the concept of government propaganda established by the Congress of the Union in the Decree that interprets its scope and the principle of impartiality has been taken up again. and application of sanctions contained in the General Law of Electoral Institutions and Procedures (Legipe) and the Federal Law of Revocation of Mandate “since it gives clarity, accuracy and precision to its legal significance.”
In addition to that: “Clarity in said concept helps to avoid future interpretations that affect and violate the freedom of expression of public servants and at the same time will make it possible to make effective the human right of people to information about public action.”
The changes specify that the objective of the LGCS is to “guarantee the citizen’s right to information on the performance and accountability of Public Entities, through government Propaganda.”
