Behind the Esquivel affair

The file delivered by Yasmín Esquivel Mossa, prior to her appointment as minister of the Supreme Court of Justice of the Nation consists of 211 pages. The public version is tested and censored, in personal data.

With her signature, addressed to whom it may concern and dated January 28, 2019, the application letter from the then magistrate of the CDMX Administrative Court of Justice affirms, “under oath to tell the truth”, to comply with the requirements indicated in the Article 95 of the Constitution.

His resume contains the evidence —diplomas, titles, and certificates— proving his degrees of study and job appointments; of the latter, only that they support public service activities. None of your business or commercial endeavors.

Exactly 40 years ago—in September 1982—he began his law degree. In that file it was not specified that he was enrolled in the Aragón campus of the then National School of Professional Studies, of the UNAM, where —unlike the Faculty of Law, in CU— the study plan had to be covered in four years.

Since October 1985 —a year before concluding his studies— Esquivel Mossa studied in Aragon and worked. First, as a legal adviser —to fulfill her social service— and then in her personal office, in the Coyoacán delegation, until July 1987.

Three months before, on May 21, the coordination of school administration issued the certificate that accredited having completed 100% of the credits; it was the last of the procedures required for his professional examination, after having registered the thesis “The ineffectiveness of unions in trusted workers of article 123, section A”, caused discharge in the Management Control department of the Benito Juárez delegation .

The General Registration Regulations then in force —it was reformed in 2012— did not establish a time limit for graduates of the Maximum House of Studies to comply with the process, but Esquivel Mossa appeared before the jury on September 25, 1987, one year after having left the ENEP Aragón.

“He had an outstanding performance, vehemently defending his arguments and positions,” recalled Javier Carreón Hernández, who was appointed as a member of the synod, “demonstrating a deep knowledge of the issue related to the treatment of trusted workers by the Federal Labor Law . Approved unanimously, Esquivel Mossa received his title until November 5 of that year, signed by the then rector, Jorge Carpizo, and the general secretary, José Narro Robles.

The validity of the degree from UNAM supported his enrollment in the doctorate in business law that he studied at the Anahuac University between 1998 and 2001, validated by the Complutense University of Madrid. Until March 3, 2009, she obtained that grade, after presenting the professional exam. On June 2 of that year the title was issued.

The current authorities of the FES Aragón and CU have opened separate investigations into the procedures carried out by Esquivel Mossa, as a result of recent complaints about the alleged plagiarism of the thesis. At the close of this space, it was confirmed that the minister had gone to the capital’s prosecutor’s office, due to the improper appropriation of her work.

“I confirm my willingness to collaborate with the authorities to establish responsibilities”, offered the minister last night on her social networks, “I am the first interested in clarifying this situation in its entirety. It is evident that the objective of these defamations is to intervene in the election process in the Supreme Court”.
