Consolidation of the labor reform, the “great commitment” for the STPS: Luisa María Alcalde Luján

The current administration has two years of management left and in what corresponds to the labor side, the Secretary of Labor and Social Welfare, Luisa María Alcalde Luján, affirms in an interview that the great commitment is called “consolidation”, since the labor reform , “the most important of the last 100 years”, not only has new institutions that must comply with proper functioning, but also because there will be a before and after with the legitimization of collective contracts that must conclude this year and there will be a different dynamic with “real” contract negotiations.

More than three years after the 2019 reform came into force, Luisa María Alcalde Luján details that in 2023 and 2024 it will “consolidate the reform, I believe that such profound changes, I insist, is not only the creation of new institutions, but it is that all workers and employers make it theirs, know it and can exercise their rights”.

In this sense, he maintained that in the case of the new labor system it is necessary to consolidate it in the sense, “one, as an ideal way to resolve conflicts through conciliation, today we are already obtaining 75% of conciliations in less than 45 days, there are We have to continue monitoring that this persists, that it is not just a starting issue, that the courts work as they should work on one side and on the other side, in the union labor issue, conclude with the period of legitimization, starting next year the first of May concludes the date so that the collective contracts can be legitimized and there will be a before and after”.

The foregoing explained why all contracts that do not have the support of the workers must be considered concluded and in this sense 2 windows of opportunity are opened or that the workers decide not to have a union in the near future and be able to negotiate individually or that they open the possibility that newly created organizations or others can better represent them. Until December, the Federal Center for Conciliation and Labor Registration reported that 10,553 legitimations of collective labor contracts were carried out

To the above, he added that it is essential to consolidate the new model “also in order to continue advancing in the recovery of profit sharing.” In addition, we have to advance in the incorporation of new groups that have been historically excluded, such as domestic workers, agricultural day laborers, and platform workers themselves.”

Labor backlog with closures in the Boards

Interviewed in her peripheral offices, she attends to matters related to the implementation of the labor reform, with the same commitment to end the backlog that exists in the Conciliation Boards that closed to make way for the new labor model.

In this regard, he affirms “it will be a complicated process, but I believe that it is being done in a very responsible way, sometimes there is wrong information that is disseminated because at no time will workers be left unprotected or forced to move from headquarters”. He added: “Today the meetings that close, which are six, in none of these cases is the office closed that will have the necessary personnel to still be able to vent matters that are still under investigation.”
