They challenge the suspension of the restructuring of the INE

The Legal Counsel of the Presidency of the Republic challenged the suspension granted by the Sixth District Court in Administrative Matters, against the restructuring of the National Electoral Institute (INE) ordered by the so-called “Plan B” of the electoral reform.

Marisol Duarte Martínez, head of the Department of Agreements and Regulatory Content of the Technical Unit for Links with Local Public Bodies of the INE, requested on April 7 an amparo against said restructuring contemplated in the reform of the General Law of Electoral Institutions and Procedures .

In the provisional suspension, the Sixth District Court in Amparo Matters declared that the restructuring of the INE has dogmatic and generic reasons, so the suspension has the purpose of avoiding harm to the public interest.

The challenge presented by the Legal Counsel of the Presidency of the Republic will be referred to a collegiate court in administrative matters to decide whether or not to maintain the provisional suspension.

“The official letters of account, signed by the Deputy Counselor for Constitutional Control and Litigation, of the Legal Counsel of the Federal Executive, on behalf of the President of the United Mexican States, through which he renders his report, are considered received. prior and files a complaint appeal against the document dated March 24, 2023, in which the requested provisional suspension was granted”, highlighted the Sixth District Court in Amparo Matters.

On April 17, an incidental hearing will be held where the judge will decide whether or not to grant the definitive suspension against the restructuring of the INE contemplated in “plan B” of the electoral reform promoted by Morena and President Andrés Manuel López Obrador.

It should be noted that, with the previous formation of the General Council, the INE argued that “Plan B” contemplates an unconstitutional impact on the labor rights of the Institute’s personnel.
