(Trends Wide) — Amber Heard’s lawyers have officially appealed her loss in the defamation case brought by Johnny Depp, arguing that there were several errors in the trial, including that the case was tried in Virginia and that the court improperly prevented Heard from presenting some evidence, according to reports. from Los Angeles Times.
Heard’s lawyers cited the exclusion from the November 2020 libel case Depp lost against Britain’s The Sun newspaper, where he referred to Depp as a “wife beater,” the LA Times reported.
The appeal also claims that Depp’s team also failed to prove “actual intent” in the case and that the jury was incorrectly instructed about the role of actual intent in the case, according to the LA Times.
In early November, Depp’s legal team appealed the court’s decision to award Heard $2 million, the LA Times reported.
The case will now go to a three-judge appeals court for a decision, according to the LA Times. Trends Wide has reached out to the attorneys representing Heard and Depp for comment and to obtain a copy of the appeals.
Depp accused Heard of defaming him in a 2018 opinion piece he wrote for The Washington Post.
The jury awarded Depp $10 million in compensatory damages and $5 million in punitive damages, Trends Wide previously reported. A Virginia judge reduced the punitive damages to $350,000 due to legal limits.
The jury also awarded Heard $2 million in compensatory damages and no money in punitive damages for his crossover lawsuit.
Heard filed the appeal on November 23 with the Virginia Court of Appeals, according to the LA Times.
Jessica Kovacevic, Heard’s agent at WME, declined to comment with Trends Wide. Range Media Partners, Depp’s talent agency, also declined to respond to Trends Wide for comment.
