The Automotive industry analyzes the possibility of filing an amparo against the cancellation of the Official Mexican Standard (NOM) 236 on the physical-mechanical conditions of the vehicles, since it argues that the decision of President Andrés Manuel López Obrador to back it down corresponds to political overtones rather than to issues related to regulation.
Guillermo Rosales, president of the Mexican Association of Automotive Dealers (AMDA) explained that in order to cancel an Official Mexican Standard (NOM) -by the federal government-, “there is a procedure that is framed within the General Law of Infrastructure for Quality and the first analysis carried out, in our opinion, the procedure was not fulfilled and therefore, We are studying the feasibility, from the legal point of view, of presenting an amparo opposing this decision.”
In a virtual press conference, he stated that the publication of the NOM 236 It was made on May 3 of this year, but later adjustments were made to the publication to postpone the entry into force until December 1, and now its total cancellation occurs. This process must be replaced, he said, both the entry into force of the standard and consequently, the implementation path.
The Ministry of Economy reported last Sunday that the NOM 236 that regulated the mechanical physical inspection was canceled as of November 4, arguing that it could affect the income of Mexican families who use their vehicles as work tools.

Fausto Cuevas, director of the Mexican Association of the Automotive Industry (AMIA) lamented the fact, considering it a contraction when it comes to having safer cars.
“We will be seeing the way forward to be able to reverse the cancellation and that we can have a norm that allows us to ensure that the cars that circulate in the country have the security devices or are in physically and mechanically acceptable conditions so that they transit through these roads”, explained the representative of the body that brings together car assemblers in Mexico.
Guillermo Rosales affirmed that with this cancellation of the NOM “there is persistence in the face of increased risks and greater accidents” in the country.
He insisted: “The argument given by the government is unjustified. There is nothing more to do than follow the thread of the public declarations of President AMLO (López Obrador) opposing this implementation, it responds to political considerations of the president.”
