CFCRL terminates more than 100 collective bargaining agreements

At least 92 union organizations lost a collective bargaining agreement, as it was not ratified by the workers, as part of the legitimation process to which all current contracts must undergo.

According to data from Federal Center for Conciliation and Labor Registration (CFCRL) -until December 16- 127 collective labor contracts were terminated, after the free, direct and secret voting processes carried out by more than 90 unions.

The union organization that has had the greatest impact due to contractual cancellation is the Industrial Union of Workers of Nuevo León (FNSI), who has lost at least 8 legal proceedings.

Some of the processes that have caused the most controversy have occurred in the automotive sector, where unions from the Confederation of Workers of Mexico they lost the contract General Motors.

In this case, the CTM had in its hands the collective bargaining agreement for more than 20 years and since there was no rapprochement with the workers, the workers decided to change to the union organization.

One more was that of the company Saint Gobaina producer of auto glass, where the workers not only voted against the current contract, but also presented a new union organization that was supported by 30% of the workers.

Thus, the Independent Union of Free and Democratic Workers of Saint Gobain Mexico, will be the one seeking the new collective bargaining agreement.

Contracts have also been canceled with the “Joaquin del Olmo” National Union of Workers and Employees of the Administrative, Fiduciary and Service Provider Activities of the Republic of Mexico, most with New Walmart de Mexico.

Likewise, the Single Union of Workers of the 3M Purification CTM Company left to be the representative of the contract of the 3M Purification company; here in this process a new independent union was presented.

It should be noted that the legitimization processes have become relevant, not only because they are carried out under the new parameters of the 2019 labor reform, with a free, secret and direct vote; if not because the governments of the United States and Canada have been very aware of its realization, and even 5 labor complaints have been derived under the mechanism of the T-MEC.

Union organizations have until May 1, 2023 to carry out this procedure, the purpose of which is to eliminate all contracts that were signed without the consent of the workers.

Data from the CFCRL – until December 9 – highlight that there are 9,823 contracts that have been submitted to the legitimation process, in which 2 million 237,492 workers have participated.

It is important to point out that once the collective contract is terminated, the workers maintain their acquired labor rights; In addition, they can choose two paths: maintain union membership with other representatives and even choose not to unionize.

With thousands of proceedings still to go, Senator Napoleon Gomez Urrutiasaid that the risks of those unions that do not comply with the legitimation process will have to be analyzed, especially since all the contracts will be terminated.
