Wintao said that China will establish a working mechanism consisting of relevant departments to take charge of combating the unjustified application of foreign legislation outside regional borders, and that “when the working mechanism confirms, based on the evaluation, that there is an unjustified extraterritorial application of foreign legislation and other measures, the competent trade department may The Council of State may issue an order stating that the relevant foreign legislation and other measures are unacceptable and not implemented or respected. The prohibition order may also be suspended or withdrawn based on actual circumstances.
The rules also stipulate that Chinese citizens can file a legal case before the local courts if the ruling or decision is based on the foreign legislation that falls under the ban order and incurred losses, and they can ask the parties benefiting from the said ruling or decision to compensate for the losses.
Relevant government departments may also provide the necessary support based on specific circumstances for citizens, legal persons and organizations if they incur large losses resulting from failure to comply with relevant foreign laws and regulations, and the Chinese government may take necessary countermeasures against the inappropriate application of the law outside regional borders based on Actual conditions and needs.
The new rules come on the heels of a set of decisions by the administration of US President “Donald Trump” that targeted Chinese companies, as well as adding dozens of senior Chinese officials to the US sanctions list, and placing an increasing number of Chinese companies on a commercial blacklist.
