Constitutional reform on the National Guard achieves the approval of 17 state Congresses

The reform that extends the permanence of Armed forces in public security tasks by 2028 it has already reached its constitutional rank, after being approved by 17 state Congresses.

This Thursday, the local legislatures of the State of Mexico, Hidalgo, Nayarit and Sonora joined the other 13 local congresses that had already endorsed in recent weeks the reform of the Fifth Transitory Article of the decree by which various provisions of the Political Constitution, in terms of National Guardpublished in the Official Gazette (DOF) on March 26, 2019.

When approved by the Permanent Constituentthe reform may already be published in the Official Gazette of the Federation (DOF).

The Permanent Constituent Assembly is made up of the Congress of the Union, federal deputies and senators of the Republic and the legislatures of the 32 states.

The army in the streets

The endorsed opinion modifies the decree of Constitutional reform of 2019 that created the National Guardwhich originally gave a term of five years, until 2024, so that the president could resort to the Armed forces to support public security matters, while the new security body was being consolidated. However, this period will now end until 2028.

It also indicates that actions performed by the Permanent Armed Forceat no time will they have the purpose of substituting the civil authorities of other government orders in the fulfillment of their powers or exempting said authorities from their responsibilities.

It is established that a bicameral monitoring commission and there will be permanent and recurrent evaluations to guarantee the conclusion of the participation of the Armed forces within the stipulated period, so that the National Guard and other public security institutions fully assume their functions.

From 2023, entities and municipalities will have additional funds from the three levels of government to strengthen their security institutions, assigning a higher percentage to those with better results.

The local congresses that endorsed this reform are:

• Oaxaca with 33 votes in favor.
• Campeche with 25 votes in favor and nine against.
• Chiapas unanimously.
• Sinaloa with 36 votes in favor and four against.
• Mexico City with 42 votes in favor, 22 against and one abstention.
• Tabasco with 28 votes in favor and seven against
• Baja California with 20 votes in favor, four against and one abstention.
• Puebla with 28 votes in favor, 10 against and one abstention.
• Veracruz with 38 votes in favor, nine against and one abstention.
• Tlaxcala with 22 votes in favor and three against.
• Tamaulipas with 19 votes in favor and 17 against.
• Quintana Roo with 21 votes in favor and two against.
• Michoacán with 26 votes in favor and eight against.
• Sonora with 25 votes in favor and seven against.
• State of Mexico with 56 votes in favor and 17 against.
• Hidalgo with 25 votes in favor, three against and zero abstentions.
• Nayarit with 24 votes in favor, five against and one abstention.
