Deputies of Morena pay for the #EsClaudia campaign

The deputies of Morena, Aleida Alavez Ruíz, Miguel Torruco Garza, Patricia Armendáriz, Mauricio Cantú, and Alejandro Robles, recognized that, like other legislators, they are responsible for hiring various billboards throughout the country to support the presidential aspiration of the head of Government of the CDMX, Claudia Sheinbaum, despite the precautionary measures issued by the National Electoral Institute (INE) against the promotion of the capital’s president.

In recent weeks, dozens of billboards showing the silhouette of Sheinbaum with the legend #EsClaudia have appeared in various states of the country. However, until now the origin of this campaign was unknown.

“Exercising our political rights, deputies of our movement promoted spectacular advertisements in various entities in support of Dr. Claudia Sheinbaum; she is freedom of expression and against INE censorship ”, defended the morenista Alavez Ruíz on her Twitter account.

While the deputy Torruco Garza expressed: “In exercise of our political and constitutional rights, deputies and deputies we place spectacular ads in support of Claudia Sheinbaum, because we are against the censorship of the INE.”

Arguing that they were paid with their own resources, the Morena federal deputies argued that the publication of these ads is part of the exercise of their political rights.

“Freely and in full exercise of my political rights, typical of a democracy like ours, I decided to join the initiative of various compañeras and compañeros legislators to hire billboards in support of Claudia Sheinbaum,” wrote Patricia Armendáriz.

INE resolution

The Complaints and Complaints Commission of the National Electoral Institute (INE), determined last November the origin of the precautionary measures, considering that there is a publicity strategy that seeks to position the idea of ​​continuity associated with the head of Government.

“Under the appearance of good law, it is considered to be facing a possible violation of the principles and rules that govern the entire electoral process, which could constitute anticipated pre-campaign and/or campaign acts, thus justifying the issuance of precautionary measures.” . Due to the above, Sheinbaum was ordered to publicly disassociate herself from the campaign in her favor, which she did, although she stressed that she had been forced to do so.

It should be noted that the General Law of Electoral Institutions and Procedures (LGIPE) establishes, in its article 443, that the performance of anticipated pre-campaign or campaign acts constitutes an infraction by the political parties. The same law, in its article 3, indicates that early campaign acts are expressions that are carried out “under any modality and at any time outside the campaign stage, that contain express calls to vote against or in favor of a candidacy.” or a party, or expressions requesting any type of support to contend in the electoral process for any candidacy or for a party”.

While the anticipated pre-campaign acts are “the expressions that are carried out under any modality and at any time during the period that goes from the beginning of the electoral process until before the legal term for the start of the pre-campaigns, that contain express calls to vote against or in favor of a pre-candidacy”.

Types of violations

Former electoral prosecutor Héctor Marcos Díaz Santana, affirmed that there are two types of sanctions in terms of elections; criminal and administrative. It is, in this last item, where the anticipated acts of campaigns and pre-campaigns are registered.

However, the electoral expert indicated that in a given case it will be up to the Electoral Tribunal to resolve a possible violation of current laws that clearly prohibit anticipated acts of proselytizing.

On whether it is possible that a possible candidacy for the 2024 presidential election could be cancelled, Díaz Santana stated that “if the INE says that such a candidate would be disqualified from participating, there would be very strong tension and that would generate an institutional crisis.” .

He added that the anticipated campaign and pre-campaign acts directly influence the equal conditions of the competitors.

“In the country we live in a complex, difficult stage, where the balance of political competition in an immediate scenario is not appreciated (…) we have to start calling it that: the ruling party candidates do not seem to have any rivalry, some opponent, who can compete under equal circumstances”, he concluded. The INE explained that the deadline for submitting applications for registration of candidacies of parties and coalitions took place on December 21 and 22, and during this period three applications for registration of candidacies were received, which were approved this Tuesday.

Therefore, for the extraordinary election to be held on February 19, 2023 in the state of Tamaulipas, Imelda Margarita will participate as a candidate for the “Va por México” Coalition (PAN-PRI-PRD); by the Green Ecologist Party of Mexico, Manuel Muñoz Cano and by the Coalition “Together we make history in Tamaulipas” (Morena-PT), José Ramón Gómez Leal.

Likewise, it was clarified that, during the application period for candidacies, neither the Local Council nor the General Council of the INE received a request from the Movimiento Ciudadano party to register any candidacy.

It was added that as of December 28, the electoral campaign period will begin, concluding on February 15, 2023.

While the electoral ban for the three days prior to election day will be from February 16 to 19, 2023, a period in which citizens will be able to reflect and decide the best option to cast their vote.

The holder of the vacant senatorial position is Américo Villarreal, who retired to compete for the governorship of Tamualipas, which he won. After that Faustino occupied the seat, however, after his death the position must be elected via direct vote.
