FGR must deliver data on container theft

The National Institute for Transparency, Access to Information and Protection of Personal Data (Inai) unanimously approved a draft resolution to instruct the Attorney General of the Republic (FGR) to search for and disclose the number of maritime containers that were stolen from the country during the governments of Enrique Peña Nieto and Andrés Manuel López Obrador, until June 27, 2022.

During the Inai plenary session, the response was revoked and it was detailed that the FGR must specify the total theft of containers, the dates, the merchandise that each one included, its value, the place where the theft had taken place, the company and, also, to know if it had been recovered or not and with its content or empty.

Commissioner Francisco Javier Acuña Llamas commented that the agency was unfortunate in answering the request for information by pointing out the “absence of information.”

He pointed out that the FGR’s response is improbable because 20 containers were stolen on June 5, in Manzanillo, Colima and it is not possible for the Prosecutor’s Office in charge of investigating the crime, not to say anything.

For her part, Commissioner Josefina Román Vergara explained that, since the constitutional reform carried out in 2014, all municipal, state and federal public servants are obliged to document all their actions; and in her opinion, this reform was to avoid declarations of non-existence of information.

“Therefore, if we make declarations of non-existence without being perfectly justified, founded and motivated, eventually, it can lead us to administrative responsibility,” said the commissioner.

Commissioner Norma Julieta del Río Venegas said that the theft of maritime containers for the transport of merchandise was a matter of major and public interest, so it is relevant that the authority provide the requested information.
