First woman to preside over the SCJN

The fact by itself is already the notable legal event of the election, even more so the majority of analysts and lawyers have ruled for the correctness of the appointment of Minister Piña.

Minister Piña is a young lawyer with a judicial career, who has demonstrated good legal judgment in the most burning issues of the SCJN. She usually defends her points of view without being carried away by the current and pressures.

In the gender struggle, the appointment of Minister Piña is certainly recognition of her career, but it is also recognition of the career of great women who have passed through and continue in the judiciary, from María Asunción Sandoval -the first female lawyer in Mexico (1898) — Senator Olga Sánchez Cordero, retired minister Margarita Luna Parra, as well as all the women who have contributed to the gender struggle and in the judicial, administrative, support trenches, justice officials, judges and magistrates. Likewise, it proposes the renewal and strengthening of the procedure of administrative responsibilities, through the issuance of a specific, clear and concrete regulation in the CJF with adherence to the principle of presumption of innocence. For this reason, he proposes that only those sanctions that have been declared firm or definitive be made known to society, not as is the case now that judges and magistrates are subjected to popular ridicule.

It will seek to implement measures that encourage the filing of complaints and denunciations, through the issuance of a regulation that, in a complete way, establishes and develops a wide catalog of precautionary measures.

Dr. Piña’s proposal is extremely interesting, since precautionary and victim protection measures are lacking in the General Law of Responsibilities or are absent or have real problems in terms of their legality and execution.

In addition, it presents with the objective of inserting the PJF within the framework of the scheme regulated by the National Anti-Corruption System, I will propose the issuance of a new institutional Code of Ethics.

In a timely manner, it raises the follow-up and strengthening of workplace violence prevention policies in jurisdictional bodies and administrative areas.

Although it outlines the use of electronic media and digital solutions in the administration of justice (E-Justice) and in administrative areas, it falls short on the matter.

Minister Piña’s work project is interesting, it exposes its diagnosis and solutions to the judiciary, in what fits in such a general document.

Based on my expertise, the possible improvements in terms of administrative responsibilities and precautionary measures five years after the validity of the LGRA are striking, infinite areas of opportunity and improvement are evident.
