(CNN) — The parents and sister of Halyna Hutchins, the cinematographer who was shot dead during a rehearsal for the movie “Rust” in 2021, filed a civil lawsuit over her death against actor Alec Baldwin, the film’s producer and others. .
The lawsuit filed Thursday in Los Angeles Superior Court alleges the defendants intentionally caused emotional distress, negligence and spousal loss in Hutchins’ untimely death, attorney Gloria Allred announced at a news conference.
Hutchins’ parents and sister live in the Ukraine and are struggling to cope with personal tragedy while living “in the midst of Putin’s war,” Allred said. Hutchins’ mother is a nurse treating soldiers at a hospital near Kyiv, and her brother-in-law is a soldier fighting in the war.
CNN sought comment from Baldwin and the film’s production company.
An attorney for the set’s gunsmith, Hannah Gutierrez Reed, who was also named in the lawsuit, had no comment.
Last fall (from the northern hemisphere) an agreement was reached between Baldwin and the producer and Matthew Hutchins, the widower of Halyna Hutchins. But Allred said this lawsuit is necessary because these family members also deserve accountability and justice, and claims that Baldwin and the film’s production team have not reached out to these family members.
“They have not heard from Alec Baldwin, the man who was carrying the gun,” Allred said, “the gun that killed his daughter.”
Baldwin and movie set gunsmith Gutierrez Reed also face criminal charges related to the shooting. David Halls, also named in the lawsuit, reached a plea agreement with the Santa Fe County District Attorney’s Office.
“What we’re looking for is an acknowledgment of what was stolen from us: the loving relationship they had with her,” Allred said. “No matter what happens with the criminal case, we are bringing this civil lawsuit to get them justice.”
Allred added: “There is no real justice when someone has been killed.”
“Justice is in finding the truth,” added co-counsel John Carpenter.
