Shocking footage of a motorbike rider being flung across the tarmac after being rear ended by a car has been captured by dashcam footage.
Video of the collision, which happened on a Queensland road near Windsor, was uploaded to Facebook by group ‘Dash Cam Owners Australia’.
The footage has quickly received hundreds of comments from outraged viewers, who are divided over which driver was to blame.
Each Australian state has different laws when it comes to performing a U-turn however it is illegal in all states to make a U-turn at an intersection unless a ‘U-turn permitted’ sign is posted.
In this case, there was such a sign, but some believe the driver filming the accident may have distracted the driver of the silver car trying to turn, ensuring they missed seeing the scooter.
But other viewers who watched the video believed it was the fault of the driver alone that rear ended the delivery scooter and sent the passenger flying.
One comment underneath the video read: ‘I don’t think that car was ever going to give way though, coming in red hot’.

Another said: ‘The only driver at fault is the car who hit the scooter, regardless of any other action they failed to see a stopped vehicle in front of them’.
However a larger majority believed the dashcam driver was to blame for the accident, because they didn’t give way to the oncoming car and motorbike.
Queensland road rules about U-turns clearly states that a driver can only make a U-turn at traffic lights when there is a U-turn permitted sign.
However, the rule also states that when doing a U-turn, the driver must give way to all other vehicles and pedestrians – even if other vehicles are facing a give way or stop sign.

To make a safe U-turn the dashcam driver should have ensured they had a clear view of approaching traffic, completed the turn without blocking the free movement of traffic and given way to all vehicles and pedestrians.
Many were quick to point out the dashcam driver had not given way.
One comment read, ‘The DC driver doing the U-turn should have given way to both of them but failed to. The scooter probably stopped because the DC driver failed to give way and he didn’t want to be hit. Unfortunately for him, that still didn’t help him’.
Some viewers said the seldom-followed road rule should be changed, so drivers in slip lanes would have the right of way, ensuring the driver making the U-turn could complete the turn safely.
Another said a sign should be in place that warned slip lane drivers of cars ahead completing U-turns.

A few viewers had other priorities and were concerned for the people whose delivery may have been inside the drivers scooter.
‘I’m feeling a bit sorry for the people who ordered their food which won’t arrive to them because of this. They’re as much a victim of this as the scooter rider!’ One said.
