The National Human Rights Commission (CNDH) issued Recommendation 168/2022 to the general director of the Mexican Social Security Institute (IMSS), Zoé Alejandro Robledo Aburto, due to delay in the care and surgical intervention of an elderly person, which caused him to lose the vision of his left eye, the only one that was functional, facts that constitute violations of human rights to the protection of health and access to health information, attributable to the staff of the Hospital General de Zona con Medicina Familiar number 76 (HGZMF-76) and to the General Hospital “Dr. Gaudencio Gonzalez Garza” of National Medical Center “La Raza” (CMN La Raza), in Mexico City.
In response, the IMSS He acknowledged receipt and reported that it is within the period established by law to analyze it. Likewise, he expressed his willingness to cooperate with the purposes of the human rights guarantor body.
On July 21, 2020, the CNDH received the complaint of the aggrieved person in his rights. Based on the evidence in the file, it was noted that, in August 2016, the victim suffered a decrease in vision in his left eye, for which he went to the HGZMF-76 Emergency Room to request institutional medical care.
The patient was referred to the third level of care at the CMN La Raza, where he was diagnosed with a vitreous hemorrhage, without expressing indications or a management plan, incurring negligence by omission by not performing the surgical treatment, which consisted of an early vitrectomy.
Said negligence cannot be individualized, since the medical records of the care are not available in the clinical file, so the responsible public servant is unknown.
According to the CNDH, given that, by November 3, 2016, the victim had not received treatment, the ophthalmology service of HGZMF-76 made a new request for definitive surgical management to the “retinal service” of CMN La Raza. The records present in the clinical file show that the surgery was performed until July 2, 2018, two years after the onset of the condition, which shows an excessive delay that does not adhere to the specific regulations for the case.
On August 30, 2018, a second surgical intervention was performed, as a result of a “retinal detachment”. There are no details of this operation in the medical file. In addition, the surveillance and follow-up actions carried out after this second intervention are not mentioned. Finally, on August 31, 2019, was the last consultation regarding the surgical intervention.
The CNDH concluded that the medical care provided to the victim by the CMN “La Raza” was inadequate for not performing the surgical treatment, which consisted of an early vitrectomy, in a timely manner, which led to the loss of sight in the left eye. With these omissions, she failed to comply with the clinical guidelines and with the regulations applicable to a clinical case such as the one described.
