When resolving a complaint filed by the PRD, due to the fact that the aforementioned Undersecretaries published on their social networks a message of open support and promotion for Ebrard with the slogan #ConMaerceloSí, the councilors Adriana Favela, Ciro Murayama y claudia zavalaagreed that these messages are openly a promotional message for the foreign minister’s public intention to be Morena’s presidential candidate in 2024.
During a session of the Complaints Commission, counselor Claudia Zavala stressed that all public servants are obliged to be constantly careful not to spread personalized propaganda and to respect neutrality.
For this reason, he said, it was clear that the messages from Martha Delgado and Reyes Zúñiga sought to position a campaign from the website “Yo con Marcelo” and with the slogan #ConMarceloSi, “in which he is evidently shown as a possible candidate , which is going to advance for electoral purposes, then (…) I think that we do have to link what positions a campaign in which an idea of an optimal candidate for the citizenry is being generated”, he maintained.
He added that, since Marcelo Ebrard is one of the people who has openly expressed his intention to aspire to the candidacy, “it seems logical to me to tell him to take care, in that duty of vigilance, of all the public officials of the Ministry of Foreign Affairs. to refrain from carrying out acts that confront or collide with constitutional functions.”
In the same sense, the counselor Ciro Murayama spoke out for stopping personalized promotion, because otherwise, public positions will begin to be used to promote themselves, something that was normal, he said, in the pre-democratic era of Mexico, where cabals were made , covered ceremonies, and it was normal for each Secretary of State, in addition to doing his job, to be planning strategies to reach the presidential candidacy.
Ciro Murayama said that this happened in the era of authoritarianism, because “now the anticipated campaign acts are sanctioned.”

“And in recent months we have begun to find a violation of that democratic framework, to repeat practices of the past, which are not only old, but today are contrary to legality and our democratic constitutional model,” he said.
Murayama said that the Undersecretaries of the Foreign Ministry use their social networks to promote the presidential aspirations of their boss, the Foreign Minister, and “that is what the Constitution does not allow. All public servants have a duty of neutrality; Before, it was normal to go all out with the boss.” He said that Foreign Minister Marcelo Ebrard should call on officials to dedicate themselves to their work and not to futurology.
Counselor Adriana Favela, president of the Complaints Commission, stated that “we have to grant precautionary measures so that these types of messages are no longer being spread. And in relation to the use of public resources, that will have to do with the merits of the matter, which will have to be resolved by the Specialized Regional Chamber (of the Electoral Court of the Judicial Power of the Federation)”.
In this framework, the INE Complaints and Denunciations Commission granted the precautionary measure considering that, from a preliminary point of view, the messages of the Undersecretaries are not about individual, spontaneous, free, personal and genuine manifestations since, from the preliminary analysis to the content consisting of phrases and a video made on September 11, 2022 from the Twitter accounts @marthadelgado and @maximilianoreyz, the hashtag #ConMarceloSí was used and they expressly refer to Marcelo Ebrard.
Consequently, both officials must remove the reported content within a period that may not exceed three hours, counted from the notification of the agreement, as well as from any other social network they manage; meanwhile, the Secretary of Foreign Affairs was ordered to carry out the necessary actions so that the high-level public servants of said Ministry refrain from making publications, and must submit proof of the actions carried out within a period of 48 hours. .
