Noticing a probable holding of anticipated campaign acts in view of the 2024 presidential succession process, the Complaints and Complaints Commission of the National Electoral Institute (INE) ordered the national leader of Morena, Mario Delgadodesist from involving the Governors of his party in supporting the presidential candidates of his party.
The members of the Complaints Commission met this Tuesday to resolve a complaint from the PAN and PRD, specifically from the latter who reported that the national leader of Morena sent a letter —disseminated on Twitter on January 15— in which he asked 12 Governors who support in their states Marcelo Ebrard, Claudia Sheinbaum, Adam Augusto Lopez y Ricardo Monrealwhom President Andrés Manuel López Obrador has considered his “corcholatas” for 2024.
In the PRD’s opinion, this call implied that the Governors carry out anticipated campaign acts and take sides in the federal process, helping their party to generate an undue advantage, which could constitute an improper use of public resources.
The Complaints Commissionmade up of the councilors Adriana Favela, Claudia Zavala and Uuc-kib Espadas, determined it appropriate to grant preventive protection, considering that said document does not have legal coverage and may contravene constitutional and legal provisions that prohibit the performance of anticipated campaign acts, as well such as the interference of public servants in the fairness of the contest.
This is due to the fact that Mario Delgado Carrillo’s text requests conduct that could constitute anticipated campaign acts and violate the principles of neutrality and equity in the contest, which could unduly benefit the Head of Government of Mexico City, to the Secretaries of the Interior and Foreign Relations, as well as Senator Ricardo Monreal Ávila, with a view to the PEF 2023-2024.
Consequently, the Commission ordered the president of the National Executive Committee (CEN) of Morena, Mario Delgado, to stop sending or disseminating the denounced document. In the same way, it ordered the partisan president himself and said political institute to refrain from preparing and sending other documents, through which they request any public servant of the three levels of government to carry out the same or similar conduct.
With respect to the Head of Government of Mexico City and 12 governors, the Commission found the preventive guardianship inadmissible, considering that these are future acts of uncertain execution.
However, the Complaints and Complaints Commission determined it necessary and pertinent to issue a pronouncement to the denounced state leaders, so that at all times they adjust their acts and conduct to the limits and constitutional parameters, stressing the obligation in their charge to conduct themselves with impartiality and neutrality, in order not to affect equity in the contest, respecting the times established by law in terms of pre-campaigns and campaigns.

Carlos Manuel Merino Campos, Governor of Tabasco; Cuitláhuac García, Governor of Veracruz; Claudia Sheinbaum Pardo, Head of Government of Mexico City; Mario Martín Delgado Carrillo, National President of Morena, and Alfonso Sánchez Anaya, Head of the Administration and Finance Unit of the Ministry of the Interior.
Meanwhile, regarding a complaint filed by the PAN and PRD in which they denounced the improper use of public resources and the violation of the principle of impartiality, by a meeting led by the secretary Adán Augusto López Hernández at the national headquarters of the Segob together with Mario Delgado and the governors of Campeche, Colima, Guerrero, Tlaxcala, Chiapas, Nayarit, Puebla, Sonora, Tamaulipas, Hidalgo, Tabasco and Veracruz, as well as the Head of Government of Mexico City, the Commission determined that it should be the Superior Chamber of the Electoral Tribunal of the Federal Judiciary (TEPJF) who decides on the substance of the use for what it does to the possible improper use of public resources.
