Israel faces a dilemma due to the lawsuit brought against it by South Africa before the International Court of Justice in The Hague, where experts say that any ruling against Tel Aviv may have major effects, even after a while.
Despite its unprecedented encroachment on international law, under American auspices, Israel faces a dilemma due to the lawsuit brought against it by South Africa before… international justice Court In The Hague, where experts say that any ruling against Tel Aviv may have major repercussions, including the issuance of arrest warrants against its leaders, even after a while.
The court accepted the lawsuit in which Pretoria accuses Israel of committing Genocide crimes collective action against the residents of the Gaza Strip, and calls for them to immediately stop the war and attempts at forced displacement.
According to court judge Yves Todi, the decision that will be issued – whatever it is – will have repercussions, even after a while.
Todi said – in a report prepared by Al Jazeera correspondent Muhammad Al-Baqali – that the exceptional measures are urgent decisions issued by the court, which are binding and in this case relate to South Africa’s request to issue a decision to stop the fighting.
He added, “The decision that the court will take in favor of or against South Africa’s invitation will have a major impact because the court represents the weight of the law, and refusing to implement is a very dangerous matter.”
Perhaps this is the reason for the uproar surrounding the 84-page case involving what South Africa said were genocide crimes carried out by Israel against the residents of the Strip.
Although states do not have the right to appeal decisions issued by the International Court of Justice, the latter does not have the tools to implement these rulings.
Big repercussions
However, refusing to implement these decisions – and it has happened before – affects the image of the state that refuses to implement them, and perhaps this explains the concern that Israel and its allies feel about the results of this call.
In recent years, the court issued two rulings in a similar context in which it ordered both Russia and Myanmar to stop their military actions.
In addition, the issuance of a ruling against Israel by the International Court of Justice (which deals with the separation of states and does not issue arrest warrants) may also be used to convict Tel Aviv in the case brought against it before International Criminal Court Concerned with the separation of individuals.
The Court of Justice decision may be a reason for the issuance of arrest warrants against Israeli leaders, as international lawyers collect evidence to submit to the International Criminal Court, and they place high hopes on the outcome of the South African case, says French lawyer Gilles Duver.
Duffer is working with a team of international lawyers to collect evidence that he will present to the Prosecutor of the International Criminal Court, and he says that they hope that the Court of Justice’s decision will help them, adding, “The (International Criminal) Prosecutor may feel isolated because of Western support for Israel, and he will find himself supported by the conviction decision if Issued by the Court of Justice.
Thus, human rights defenders place high hopes on South Africa’s lawsuit, and hope that the tree of justice will blossom once again.
