Judge determines that “El Bronco” must remain in preventive detention in the Apodaca Prison

Monterey, NL. The Control Judge of the Judicial Power of the state of Nuevo León linked the former governor, Jaime Rodriguez Calderonand ordered preventive detention as a precautionary measure, because he considered that he allegedly received resources for the electoral campaign when he ran as a candidate for the Presidency of the Republic in 2018, which the law considers as an electoral crime.

The Prosecutor’s Office Specialized in Electoral Crimes of the state of Nuevo León (FEDENL), filed an accusation against Jaime Heliodoro “N”, in the initial hearing held before a Judge of Control and Oral Trial of the state of Nuevo León, for the electoral crime related to receiving contributions of money when there is a legal prohibition for it, in accordance with the provisions of article 15 of the General Law on Electoral Crimes.

In that sense, the Control Judge determined an order to link to the process according to the background of the investigation and based on the evidence exposed by the Specialized Public Ministry, which established that an act that the law points out as an electoral crime and that there was a probability that the accused committed it.

Subsequently, it was decided on the precautionary measure requested by the Prosecutor’s Office and the Control Judge issued preventive detention, defined in article 155, section XIV of the National Code of Criminal Procedures.

However, the Control Judge, Carlos Alberto Salas, decided to refer the investigation file to a District Judge, because the defense argued that the alleged electoral crime is of a federal nature, not a local one, for which reason the investigation file was must send to a District Judge.
