The Third District Court in Matters of Amparo and Federal Trials in the State of Mexico granted a definitive suspension to Ovidio Guzmán López, “El Ratón”, against the arrest warrant issued by a federal judge in our country,
It should be noted that on February 21, a control judge from the Federal Criminal Justice Center in Hermosillo, Sonora, presented the first arrest warrant against Ovid Guzman Lopez in Mexico, although the crimes for which it was issued were not revealed. However, this order had not yet been executed against the detainee.
Everardo Maya Arias, Third District Judge in Amparo Matters and Federal Trials based at the Federal Justice Center of Almoloya, State of Mexico, determined that the final suspension protects Ovidio Guzmán López from crimes that do not warrant informal preventive detention.
This judicial resolution occurred just one day after the Control Judge of the Federal Criminal Justice Center in Almoloya, State of Mexico, Rogelio Díaz Villarreal, formally notified Ovid Guzman Lopez the extradition request requested by the United States to be tried in Illinois and New York Courts, for 11 counts of trafficking and distribution of cocaine, methamphetamine and marijuana, as well as money laundering.
“I am not the person they believe, that the United States claims,” said “El Ratón”, who denied being the son of drug trafficker Joaquín “El Chapo” Guzmán, although he identified himself before the judge as Ovidio Guzmán López.
Ovidio Guzmán was arrested on January 5 in Culiacán, Sinaloa, although the federal authorities did not release videos of his capture, unlike in October 2019 when he was apprehended for the first time, and later released on the instructions of President Andrés Manuel López Obrador.
Ovidio Guzmán will remain confined in the Altiplano federal prison while the Ministry of Foreign Affairs (SRE) processes the evidence offered by Guzmán’s defense, for which he will have until March 30. From this, another 20 days will run for the defense to prove their statements before the control judge, who would then be able to decide whether or not the extradition proceeds.
On February 27, the Department of Justice submitted to the Attorney General’s Office (FGR) the request file for Guzmán López, alleged leader of the “Los Menores” faction of the Sinaloa Cartel, on charges of criminal association to distribute cocaine, methamphetamine and marijuana, as well as money laundering.
