Judge grants definitive suspension to transfer from the National Guard to Sedena

The Ninth District Judge in the state of Guanajuato, Karla María Macías Lovera, granted this Monday the definitive suspension that stops the transfer of the National Guardthe Secretary of National Defense (Sedena), and leave it for now under the command of the Secretary of Security and Citizen Protection (SSPC).

In this way, despite the fact that last week a court revoked the provisional suspension that Judge Macías initially granted, the judge granted the definitive suspension on Monday.

Last week the Second Collegiate Court on Administrative Matters in Guanajuato revoked the temporary suspension that the judge had granted on October 10 to stop the administrative and operational transfer of the National Guard to the Sedena.

This prior to General Prosecutor of the Republic (FGR) filed a complaint against the provisional suspension granted by the same Ninth District Judge in the State of Guanajuato.

Judge Gerardo Mendoza also argued that the amparo appeal initiated by Castro Gómez was inadmissible because he did not demonstrate a legal or legitimate interest in the administrative act approved by Morena legislators and allies in the Congress of the Union.

In this way, the Second Collegiate Court denied Castro Gómez the right to file an amparo appeal against the transfer order from the National Guard to the Sedena.

It should be noted that other organizations such as Fuerza Ciudadana Uniendo Caminos México, Unión Cívica 1 País, the legal firm AC&AC Asociados and Tojil Eeek have promoted up to 53 more amparos against said order.
