Land expropriated for expansion of Suburbano to AIFA

Despite neighborhood protests, the Secretariat of Infrastructure, Communications and Transportation (SICT) released this Thursday the second publication of the expropriation decree of a 5.2-hectare area in the municipalities of Tultepec and Tultitlán, State of Mexico, to build a maneuvering yard of cargo necessary in the extension of the Suburban Train to the Felipe Ángeles International Airport (AIFA), with which it can now occupy the land.

The decree, published in the Official Gazette of the Federation (DOF) and that will have the signature of President Andrés Manuel López Obrador, specifies that the agency integrated the expropriation file number 01/MEX/2022, where it justified the suitability of the assets. to serve the cause of public utility and build the cargo maneuvering yard.

In line with the legal requirements, it previously made two public utility declaration publications (July 15 and 22).

Despite the fact that the inhabitants of the two municipalities have expressed their disagreement with the relocation of the patio (as part of the expansion of the Lechería station to the AIFA), there is no longer any possibility that their demand not to use the land will be met because it affects them. directly.

In accordance with the Expropriation Law, within ten business days following the notification of the corresponding decree (in this case the second publication), the interested parties may resort to a judicial proceeding. However, “the sole purpose of the procedure will be to dispute the amount of compensation and, where appropriate, demand payment of damages.”

Prior to the publication of the decree, the Institute of Administration and Appraisals of National Assets (INDAABIN) issued the appraisal opinion in which the amount of compensation to be paid for the expropriation of the object surface is determined.

Said action allowed the SICT the prior occupation of five fractions of land affected by the declaration of public utility with the holders of the rights, and granted them an advance payment on account of the compensation, while the issuance of the expropriation decree is processed, in accordance with the corresponding regulations.

As part of the argument to occupy the land, the federal government stated that the cargo maneuvering yard is essential to carry out various railway operations, such as the formation of trains, loading and unloading of goods.
