National Human Rights Commission recommends to legislators the “transformation” of the INE

The National Human Rights Commission (CNDH) issued this Sunday a statement in which he attacked the INE, and spoke for the “transformation” of the electoral body with precepts proposed by President Andrés Manuel López Obrador. However, lawyers warned that the agency committed an unconstitutional act, by ruling on an area in which it has no jurisdiction.

In his recommendation to the Congress of the Union and pronouncement on the electoral reform that is discussed in the Chamber of Deputiesthe CNDH recommended the “transformation of the INE”.

The recent behavior and history of the National Electoral Institute (INE), with few exceptions, is the same history of the Federal Electoral Institute (INE) and the former Federal Electoral Commission, autonomous bodies in name only, partial instruments of sabotage of the will of the people, which has only served to maintain vices that for years, if not for centuries, have tainted our electoral processes,” said the CNDH headed by Rosario Piedra.

In accordance with the initiative of President López Obrador, the CNDH supported the idea of ​​renewing the electoral councilors by popular vote, saying that it has been a demand for “democratic struggles.”

“The CNDH makes a public, respectful call to the legislators of the Republic so that, taking the aforementioned and subsequent democratic struggles as a reference, they review the current electoral legislation, carry out an honest, serious analysis that reflects current citizen expectations. and build a reform that grants certainty about the organization of the elections”, he stated.

However, lawyers immediately warned that this recommendation and pronouncement of the CNDH It is an unconstitutional act, since the Third paragraph, section B of article 102 of the Political Constitution of the United Mexican States, establishes that the autonomous bodies for the protection of human rights “will not be competent in electoral and jurisdictional matters.”

“The CNDH not only has he surrendered to López Obrador, but now he is calling for the destruction of the INE. This recommendation violates the Constitution. The CNDH is incompetent in electoral matters and repeats the government’s lies,” said attorney Javier Martín Reyes.
