PHILADELPHIA (CBS) – The person charged with killing 22-year-old David Padro, Jr. outdoors Pat’s Steaks was defending himself, based on Paul Burkert’s lawyer.
A. Charles Peruto, Jr. tells Eyewitness Information Padro attacked his consumer after tapping Burkert’s automotive whereas parking.

“There’s little doubt about it. However the deceased overreacted. There was no injury in any way,” Peruto, Jr. tells CBS3. “The deceased’s spouse or girlfriend tried to calm him down saying it wasn’t that critical.”
Peruto says Burkert tried to order from Pat’s Steaks and go away, however Padro “wouldn’t let the incident go” and slammed into Burkert.

Through the battle that was caught on digital camera, Burkert grabbed his gun. Peruto tells Eyewitness Information he doesn’t have a carry allow.
“He lastly received a maintain of his gun and shot one time. He doesn’t know the place he hit him,” Peruto says. “He fled, made it to tenth Avenue, noticed a cop and flagged him down.”
Burkert faces homicide, conspiracy, and firearms prices. On Wednesday, Philadelphia Police charged Jaime Frick with murder in relation to the capturing. Authorities affirm to CBS3 Frick is Burkert’s girlfriend.

The Padro household was unavailable for remark Wednesday.
