Pemex contributed 229,526 million pesos less to the treasury in 2022: SAT

Payment of taxes from Petróleos Mexicanos (Pemex) to the Tax Administration Service (SAT) was 92,186 million pesos between January and December 2022, which meant an annual contraction of 73.4% in real terms, according to the Tax and Management Report corresponding to the last quarter.

In other words, Pemex paid 229,526 million pesos less in taxes compared to what was recorded in the same period last year.

To put it in perspective, the SAT and therefore the Ministry of Finance and Public Credit (SHCP), have stopped receiving the equivalent of more than three times the payment of the pensions of the workers of the oil company itself and which for this year is 73.908 million pesos.

The participation of the collection to Pemex was located at 3% of the more than 3.8 trillion pesos registered as tax revenue. The participation of the oil company is the lowest since the Tax Administration Service keeps the record.

In 2021, the State Productive Company contributed 321,712 million pesos in tax revenue, which represented 9% of the collection that year.

One of the reasons why the participation of Pemex in tax revenue in 2022 is due to tax incentives on the Special Tax on Production and Services (IEPS) on gasoline and diesel. As well as the complementary fiscal stimulus that applies to the Value Added Tax (VAT) and Income Tax (ISR) of those who sell or import fuels in the country.

In this sense, the SAT reported that fiscal incentives for gasoline exceeded 373.018 million pesos. Of said amount, 243,172 million pesos of the fiscal stimulus to the IEPS and 129,846 million pesos of the complementary fiscal stimulus. This was in line with the projection that fiscal stimuli would cost between 350,000 to 400,000 million pesos last year.

Stimuli stopped Huachicol

The fiscal incentives for gasoline also prevented fuel theft and smuggling, since by not requiring the payment of the IEPS upon importation, incentives against smuggling activity are removed. In addition, the return of the complementary stimulus per liter in first-hand sales helped, explained the SAT.

The federal treasury detailed that the legitimate supply, made up of Pemex production and imports subject to payment of the corresponding taxes, reached 423.8 million barrels in 2022, that is, 86% of the total supply of 490.5 million. of barrels.

“It is presumed that 66.7 million barrels were illegally entered the market, compared to 2021 there is a reduction of 34.9 million barrels, where the estimated volume of smuggling and theft was 101.6 million barrels,” explained the dependence.

SAT confirmed that the tax revenues

Los tax revenue they registered 3 trillion 812,520 million pesos between January and December 2022, which meant an annual contraction of 0.9% in real terms as a result of fiscal stimuli for gasoline. It is also the first annual drop in tax revenue since 2017.

The figures of the SAT report that the provisions of the Federal Income Law (LIF) 2022, in which it was estimated that tax collection would be 3.9 trillion pesos, however, only 96.7% of what was programmed was fulfilled. In other words, there was a shortfall of 132,000 million pesos.
