PRD presents in the SCJN action of unconstitutionality against the electoral “Plan B”

The national president of the PRD, Jesus Zambranopresented an action of unconstitutionality before the Supreme Court of Justice of the Nation (SCJN) against the first electoral reform package (Plan B) approved by Congress and promulgated by the president Andres Manuel Lopez Obrador.

On the steps of the Supreme Court, after presenting the appeal, Zambrano Grijalva said: “we have just presented as PRD an action of unconstitutionality against the General Law of Social Communication and the General Law of Administrative Responsibilities that they are part of the package called plan B, which is that electoral mess that they sent as a reform.”

Accompanied by the PRD coordinator in the Chamber of Deputies, Luis Cházaro, and the PRD representative before the INE, Ángel Ávila, the PRD national leader stressed that this Monday the deadline for filing appeals against said regulations, which are intended to -he said-, “throw back all the reforms that are related to the media and the administrators of public servants.”

He stated that these reforms are contrary to the legal changes that were made after 2006, when López Obrador himself -as a presidential candidate- accused irregularities such as presidential intervention in the electoral process.

“When even business chambers went to buy spaces on radio and television to disqualify political adversaries and these 2007 reforms for which the PRD fought to support that this type of irregular acts were no longer committed, are the ones that now from the National Palace , the promoter of those post-electoral movements of 2006 and the protests that followed, now seeks to tear them down to do and undo; so that public officials can do whatever they want using public resources to have campaigns without equity, transparency and without questioning the use of public resources, with anticipated campaign acts, and that there are no sanctions for disqualifications in the ( conferences) morning ”, he added.

He mentioned that the appeal presented before the Court seeks to invalidate the reforms to the General Law of Social Communication and the General Law of Administrative Responsibilities, so that they do not apply in the federal elections next year. He said that for this the SCJN must resolve before next June.

“We expect a rigorous and in-depth analysis of all of this (by the ministers), by the highest court in charge of making these decisions and that they do so within a peremptory term, because these issues must be resolved before September in which the federal electoral process of 2024 begins; If they do it as soon as possible, it will be much better because precedents of being in violation will not be set and that have been sanctions by the INE and the Electoral Tribunal, ”he said.

Zambrano pointed out that in the unconstitutional action the PRD also argued possible violations of the legislative process, because the reforms were approved without an exhaustive study in commissions.

It should be noted that the leader of the PAN, Marko Cortés, will also present this Monday, January 23, an action of unconstitutionality with the same purpose. For his part, the president of the INE, Lorenzo Cordovaindicated that this institute will do the same in the coming days.
