Senate declares constitutional the reform to extend the presence of the Army in the streets to 2028

The Senate of the Republic made the declaration of constitutionality of the remodeling which extends to 2028 the participation of the Armed Forces in matters of public security and it was sent to the Official Gazette of the Federation (DOF) for its publication.

“The Chamber of Senators declares that the Fifth Transitory Article of the decree amending, adding and repealing various provisions of the Political Constitution of the United Mexican States in matters of National Guard“, said during the ordinary session of this Wednesday the president of the Senate, Alejandro Armenta Mier.

It should be remembered that on Tuesday, the Chamber of Deputies also issued the declaration to formalize the constitutional nature of this reform.

The declaration of constitutionality of this reform occurred after the majority of the state Congresses have approved the decree sent by the Congress of the Union to the 32 local legislatures.

For a constitutional reform to take effect, it must be approved by more than two-thirds of the votes of the Chambers of Deputies and Senators, and also by at least half plus one of the state Congresses, that is, of 17 legislatures or more.

The state Congresses that have endorsed the draft decree are:

• Quintana Roo
• Michoacan

• San Luis Potosi
• Durango
• Coahuila
• Baja California Sur
• Guerrero

The Congress of Guanajuato it was the first legislature to reject the decree, while the analysis and vote of the congresses of Aguascalientes, Chihuahua, Jalisco, Morelos, Nuevo León, Querétaro, Yucatán and Zacatecas is still pending.

The approved opinion stipulates that during the nine years following the entry into force of the decree, while the National Guard develops its structure, capabilities and territorial implementation, the President of the Republic may have the permanent Armed Forces in public security tasks.
