Sushi chef sued manager for HARASSMENT after staying despatched rota on WhatsApp in early hours of the early morning

A Waitrose sushi chef has sued his employer for harassment following his boss Whatsapped him the team rota just after midnight.

The tribunal listened to: ‘On 4 January 2020, at about 00:29, Mr Lohani sent out the rota for the following 7 days. He despatched it to the staff of (the organization) who would be doing the job at the kiosk that week, such as [Mr Mainali].

‘He despatched it via WhatsApp. He did not deliver it to [Mr Mainali] only. He did not pick the time of sending to annoy [Mr Mainali] or any one else.

‘He experienced imagined that persons would read through the message when hassle-free to them, and experienced not predicted them to read/respond straight absent (and no response was automatically required, unless there was a issue functioning the specified shifts).

‘[Mr Mainali’s] telephone manufactured a sound when this information was acquired. That had not been Mr Lohani’s intention he had merely given no assumed to that risk. [Mr Mainali] and his family members ended up asleep, and were disturbed by the mobile phone alert.’

The tribunal heard he angrily responded ‘This is quite incorrect to submit at midnight. Go f*** yourselves’, to which Mr Lohani replied ‘Watch your mouth, I didn’t question you to check out now’.

Many months later the two experienced an indignant confrontation at the sushi counter.

Mr Lohani accused Mr Mainali of ‘becoming extremely intense and hoping to punch him’ while keeping a knife in his hand – while the chef reported his business companion experimented with to headbutt him when ‘block[ing] his escape route’.

The tribunal identified that both of those men’s account of the incident was exaggerated and only involved some ‘pushing and shoving’.

‘Between the two of them ahead of issues became way too overheated, there was a realisation that getting a incredibly intense conversation in Waitrose throughout opening hours was not sensible for by themselves as folks, or for their business enterprise,’ the panel located.
