They ask SCJN to consider DH in pretrial detention

The Office in Mexico of the High Commissioner of the United Nations Organization for Human Rights called on the Supreme Court of Justice of the Nation (SCJN) to guarantee respect for human rights, as far as informal detention is concerned. .

Through its social networks, the UN-DH requested the Supreme Court that in the framework of the discussion of the new project of informal preventive detention, which took place on November 22 and will be resumed in today’s session in the plenary of the SCJN, to take into account international standards on the matter, in which its arbitrary nature is accredited.

On August 29, the UN-DH issued the Human Rights Standards on informal pretrial detention and the obligation to take measures to make internationally recognized rights and freedoms effective, in said document it states as a conclusion that informal pretrial detention is a figure incompatible and irreconcilable with international human rights standards.

It also indicates that this measure disrupts and corrupts the foundations of the accusatory criminal justice system and is a violation of judicial independence. In addition, he describes the measure as “a false exit that goes against the principles of the citizen security paradigm.”

In the work presented previously, it is stated that, due to the previous conclusions, international organizations and mechanisms have recommended that informal preventive detention be repealed in the country.

On the other hand, the document indicates that, derived from its international obligations, the Mexican State has the obligation to adopt the necessary measures to make effective the rights and freedoms that are recognized throughout the world.

Minister President Arturo Zaldívar, summoned the plenary session to continue with the debate on informal preventive detention during the session to be held today.
