Pending in Congress, eight initiatives on the treatment of migrants

Despite the fact that in recent years migratory flows in Mexico present historically high figures —which has led to an increase in detentions— at the legislative level, few proposals have been presented to regulate the treatment that the authorities grant to people migrants.

Throughout the LXV legislature of the Congress of the Union, there are eight initiatives that have been presented in both Chambers.

Through the deputies Elvia Yolanda Martínez Cosio, the parliamentary group of the Movimiento Ciudadano has proposed to reform article 111 of the Migration Law, with the aim of accelerating the resolution of the migratory situation of foreigners, by proposing that the National Institute of Migration (INM) will resolve the immigration status of the foreigners presented within a period of no more than 72 hours, counted from their presentation.

In addition to specifying that accommodation in immigration stations may only exceed 7 business days, since currently the law can mark between 15 and 60 days. This initiative has been frozen in Commissions since November 2022.

Likewise, the deputy Jorge Álvarez Máynez, coordinator of MC in San Lázaro called to reform the Migration Law and the General Education Law, so that no element of the Armed Forces, National Guard, police corporations or public security request people to verify their immigration status, nor can it detain them for having an irregular immigration status in the country.

Prohibit punishment cells, as well as any mechanism of coercion that violates their human rights in immigration stays; establish that all those presented will have the right to receive advice and support before the instances where they can present their complaints and complaints, from the moment they enter the immigration station and provide that migrants may not be subject to collective expulsion measures.

In addition, Senator Gina Andrea Cruz Blackledge (PAN) proposed amending the law to establish that state and municipal authorities will have complementary and concurrent powers with the SRE, for the establishment and management of immigration stations, the protection of the rights of migrants in their path.

While for Morena, the deputy Socorro Irma Andazola Gómez, proposed the creation of a national registry of migrants presented or retained in immigration stations.
