The Attorney General of the Republic announced that it will proceed criminally against the head of the INM, Francisco Garduno Yanezas well as the General Director of Immigration Control and Verification, Antonio Molina Diazfor omissions in carrying out their charges that led to the death of 40 migrants due to the fire inside the immigration station in Ciudad Juárez, Chihuahua.
According to FGRboth directors of the National Migration Institute, engaged in alleged criminal conduct, by failing to comply with their obligations to monitor, protect and provide security to the people and facilities in their charge, promoting the crimes committed against 65 migrants (40 fatalities and 25 injured) at the Provisional Immigration Center in Ciudad Juárez, Chihuahua, on the night of March 27.

Said accusations derive from the background investigation carried out by the FGR, who stressed that It was not the first time that a fire occurred in INM facilitiessince on March 31, 2020, a similar case had been registered in the INM migration center, in Tenosique, Tabasco, where one person died and 14 others were injured.
The foregoing generated a recommendation from the CNDHwhich indicates a pattern of conduct in which the security measures that were essential and mandatory in these cases have been omitted by those responsible.
While various opinions of the Superior Audit Office of the Federation in recent years “reindicate, with complete clarity, the faults and omissions that continue to be committed in the INM; and they indicate a pattern of irresponsibility and omissions that has been repeated and that has been the cause of these unfortunate events already mentioned.”
For this reason, the FGR argued that this whole series of illegal and negligent behaviors were evidently fundamental elements that led to the commission of crimes by the commissioner of the National Institute of Migration, Francisco Garduño Yáñez, as well as the General Director of Immigration Control and Verification, Antonio Molina Diaz.
Likewise, it explained that they will proceed criminally against the public servants Salvador “N”, Juan “N”, Cecilia “N” and Eduardo “N”, who are directly linked to the conduct that generated the homicides and the injuries suffered by the victims of these crimes.
And in the case of the private security company and the INM itself, the FGR accused that both parties signed contracts by direct award, omitting their public bidding obligations and generating costs double what is paid in the public sector for the same services.
Until now, There are 11 people identified as possible perpetrators of the death of 40 migrants during the fire at the Provisional Immigration Center in Ciudad Juárez, Chihuahua, on the night of March 27, when the migrants held at the immigration station protested and set fire to the mats that were inside the men’s area, in which 68 people were detained.
The FGR has obtained arrest warrants and links to proceedings against 5 people; migration agents Daniel Goray Yosioka, Rodolfo Collazo de la Torre and Gloria Liliana Ramos García; private security guard Alan Omar Pascual, and migrant Jaison Daniel Catari Rivas.
In this regard, the FGR explained that the officials of the National Migration Institute (INM) and the private security element will be tried for the crimes of homicide and injury, both intentional, as perpetrators by Commission and by Omission; while the migrant was linked as the perpetrator by action, of the crimes of homicide and intentional injuries, for setting fire to the mattresses in the Provisional Stay.
“With the evidence obtained there, it has been possible to continue the investigation to determine the criminal responsibilities of the entire structure linked to these crimes, both within the INM and the aforementioned private security company,” the FGR stressed.
Finally, the Prosecutor’s Office stressed that the INM is a decentralized administrative body, whose purpose is the execution, control and supervision of all migration policies at the national level. And, because of this, he has investigated two parallel lines of information; the first, within said decentralized body; and the second, in the area of the private security company indicated.
