COLUMBUS, Ohio (AP) — A federal jury has identified that a white Ohio law enforcement officer did not violate a Black teenager’s civil rights when he shot and killed the boy when responding to a reported armed robbery.
Jurors arrived at their verdict Wednesday in a lawsuit submitted by Tyre King’s grandmother. It challenged the law enforcement account of the capturing, alleging that the 13-year-old’s loss of life resulted from too much drive, racial discrimination and a failure by the law enforcement department to adequately examine and self-discipline officers for racially enthusiastic or unconstitutional behavior.
Columbus officer Bryan Mason shot King in the head and torso on Sept. 14, 2016, as the teenager ran from police and right after King arrived at for what police discovered was a BB gun in his waistband, authorities have reported. The gun, uncovered at the scene, was created to appear like a genuine firearm and equipped with a laser sight.
The suit also named the city and its law enforcement office as defendants, but a federal judge ruled past summer time that there is no proof the city and the law enforcement division violated Tyre’s civil rights, that means they could not be held legally liable.
The family’s lawsuit cited witnesses who reported Mason used a racial slur immediately after firing and that the BB gun Tyre reportedly experienced wasn’t obvious.
Mason, who has said he feared a “gunfight,” contended that he acted fairly to protect himself and denied possessing directed a slur toward the teens. A grand jury decided not to carry charges versus him.
Attorneys for Mason and King’s household did not promptly respond Thursday to messages seeking comment on the verdict.
