The Seventh District Judge of Federal Criminal Proceedings of Mexico City granted house arrest to the former leader of the Guadalajara Cartel, Miguel Angel Felix Gallardoso that the sentence of 40 years in prison that was imposed on him in 2003 for stockpiling weapons, bribery and drug trafficking continues at home.
The judicial resolution was adopted on September 7, although the federal and prison authorities have not revealed whether it has already been executed, that is, that the drug lord has already been granted house arrest.
In March of this year, the Supreme Court of Justice of the Nation (SCJN) declared inadmissible the request made by Félix Gallardo’s defense to review his sentence for arguing that he had been tortured during his detention in 1989.
“This appeal for review is dismissed as inadmissible, by virtue of the fact that the origin requirements referred to in section IX of article 107 of the Political Constitution of the United Mexican States, in force after the constitutional reform published in the Official Gazette, are not met. of the Federation on March 11, 2021, since its resolution did not have an exceptional interest in constitutional or human rights matters, ”the rejection agreement mentioned.
Miguel Angel Felix Gallardo was arrested on April 8, 1989. He was a partner at the time of drug traffickers Pablo Emilio Escobar Gaviria y Gonzalo Rodriguez Gacha, whom he helped transport drugs to the United States. He is the uncle of Sandra Ávila Beltrán, “Queen of the Pacific”, and a relative of the Arellano Félix brothers. He is incarcerated in the Puente Grande high security prison in Jalisco.
On August 20, 2021, the president Andres Manuel Lopez Obrador He said that he could grant an amnesty to release Félix Gallardo, who is serving a 40-year sentence, for reasons of health and age.
If it is justified (…) of course yes (I would give him amnesty) because he, due to age, due to illness, could already leave, “said López Obrador.
It should be noted that the Second Collegiate Court in Criminal Matters denied in January of this year an amparo to Gallardo against his conviction, considering that it was a court case that met the legal requirements.
“It lacks powers to rule on the processing of said incidental request, since it is not contemplated within the regulations that govern the actions of this jurisdictional body within this direct amparo proceeding,” the court said at the time.
The former leader of the Guadalajara Cartel was also sentenced to pay 20.8 million pesos for compensation for the damage to the relatives of the former DEA agent, Enrique “Kiki” Camarena Salazar.
