The Ministry of Economy began the process to operate the “Compliant Company in Foreign Trade Program”, with which it will assume commitments that Mexico agreed to in the World Trade Organization (WTO).
With this program, companies will be certified in a comprehensive manner and all government stakeholders involved in international trade and that intervene in fields from the environment and labor, to consumer protection, national security or protection against health risks, will participate. for instance.
“We need a certification in Mexico that horizontally has all the scope of the WTO Agreement in terms of compliance and trade facilitation and that all the agencies or dependencies of the federal government that intervene in trade recognize it,” said Israel Morales, director of treaties of the National Council of the Maquiladora and Export Manufacturing Industry (Index).
Currently, 63 WTO members apply this type of program, which originated from the Trade Facilitation Agreement (AFC) of that organization, which Mexico put into force in 2017.
Already around 1,000 companies in Mexico are certified as Authorized Economic Operators (OEA), which allows them to enjoy certain advantages to streamline their customs procedures if they meet requirements related to the supply chain.
Mexico also grants another certification to some 3,500 companies, related to obtaining a VAT and/or IEPS tax credit, of a purely fiscal nature. Morales added that this time it is about not only the Tax Administration Service (SAT) or the Ministry of Economy certifying, as is currently the case with VAT-IEPS and the OAS, but also Sedena, Cofepris, Semarnat and the Profepa, among others, recognize this new certification. As possible examples of the benefits that the fledgling program could include are, according to Morales: opening facilities or new production lines, with notices and not with permits; reduce certain sanctions in foreign trade operations, or extend the validity of permits.
With regard to the new certification, the Ministry of Economy launched the incitement to those interested in participating in the “Pilot of the Compliant Company in Foreign Trade” (ECCE), which will have the purpose of generating an accreditation model of best practices in matters of foreign trade regulatory compliance by companies established in Mexico that carry out international trade operations.
Of the applicant companies, 50 will be selected, ensuring that they are from different sectors and sizes.
This pilot seeks to become the “Compliant Company in Foreign Trade Program”, comparable to international models implemented by Mexico’s main trading partners.
